Rent agreements are just for eleven months
Indian law has also developed rules for tenants. One of these comprises the legislation about rent agreements. Though there are twelve months in a year, under Section 17 (D) of the Indian Registration Act, 1908, it is not required to register a rent agreement or lease agreement for less than a year. A landlord can so create a rent arrangement for eleven months without registering. Landlords and tenants do not have to visit the sub-registrar’s office to register the paperwork and pay the registration fee even when renting a dwelling.
The primary factor causing conflict between landlord and tenant
Experts claim that most of the Indian rent regulations created have favoured the tenants. Under such circumstances, it is challenging for a property owner who wishes to leave the property from a tenant after having conflicts with a tenant.
This is how it helps in case of disagreement
The property owner must fight a court struggle for years for his property due to a little error. This is the primary reason the rent agreement is legally valid, but only an 11-month notarized rent agreement is made. Should an argument develop, the agreement can be offered as proof. Under the Rent Tenancy Act, the court has the authority to set rent should a disagreement arise, and the matter ends before the court. The landlord cannot so charge more rent than that.
No need to stop by the registrar’s office
Making an 11-month rent agreement also greatly benefits stamp duty and registration fees as, should the rent agreement be signed for less than a year, the stamp duty owing on it is not required. The landlord has the 11-month rent agreement to her advantage. The tenant’s responsibility is to pay the rent agreement cost. Usually, a notarized rent agreement is drafted on a stamp paper valued at Rs. 100 or Rs. 200
